Agreement

These Terms of Use govern your access to and use of mobile applications, websites, and related digital services published by Paradise Technology LLC, including Walk Up Anthems, Boating Days, and other apps we may release (collectively, the "Services"). By downloading, accessing, or using any Service, you agree to these Terms.

If you do not agree to these Terms, do not use the Services.

Eligibility and Accounts

You may use the Services only if you can form a binding agreement under applicable law. If you use a Service on behalf of an organization, team, or household, you represent that you have authority to accept these Terms on that party's behalf.

Some features may depend on third-party platform accounts such as Apple ID, iCloud, Apple Music, or App Store billing. You are responsible for maintaining access to those accounts and complying with the terms imposed by those providers.

License and Permitted Use

Subject to these Terms, Paradise Technology LLC grants you a limited, non-exclusive, non-transferable, revocable license to download and use our mobile applications for your personal or internal organizational use.

You may not:

• copy, modify, distribute, sell, lease, or sublicense the Services except as expressly permitted by law
• reverse engineer, decompile, or attempt to extract source code except where that restriction is prohibited by law
• use the Services in a way that violates any law, regulation, or third-party right
• interfere with the security, stability, or proper operation of the Services
• use the Services to upload, publish, or share content you do not have the right to use

User Data and Shared Content

You retain responsibility for the data, names, media selections, team details, and other content you enter into the Services. You represent that you have the rights and permissions needed for any content you add, publish, or share through the Services.

If a Service allows you to share information with other users, families, teams, or invitees, you are responsible for what you choose to make available. Do not submit content that is unlawful, infringing, misleading, harmful, or invasive of another person's privacy.

Subscriptions, Purchases, and Billing

Some Services may include paid features, subscriptions, or in-app purchases. Pricing, billing intervals, trial offers, and feature availability may vary by app and storefront.

All App Store transactions are processed by Apple, not by Paradise Technology LLC directly. Your purchases are subject to Apple's billing terms, and you must manage cancellations or subscription changes through your Apple account settings unless a specific Service states otherwise.

Except where required by law, fees are non-refundable once charged.

Third-Party Platforms and Services

Our Services may rely on Apple platform services and integrations such as the App Store, StoreKit, iCloud, CloudKit, Apple Music, WeatherKit, MapKit, and device operating system features. We do not control those services and are not responsible for their availability, security, pricing, policies, or performance.

Your use of third-party services is governed by the applicable third-party terms and privacy policies.

Intellectual Property

The Services, including their software, branding, design, text, graphics, and other content provided by Paradise Technology LLC, are owned by or licensed to Paradise Technology LLC and are protected by intellectual property laws.

These Terms do not transfer any ownership rights to you. "Paradise Technology", "Walk Up Anthems", "Boating Days", and related names, logos, and product branding may not be used without prior written permission except to identify our Services in a factual manner.

Service Availability and Changes

We may update, improve, suspend, or discontinue any part of the Services at any time, including features, integrations, pricing, and supported devices or operating system versions.

We may also publish app-specific rules, feature limitations, or supplemental terms for individual products. If supplemental terms conflict with these Terms for a specific Service, the supplemental terms control for that Service.

Termination

We may suspend or terminate your access to any Service if we reasonably believe you violated these Terms, misused the Service, created legal risk, or interfered with other users or systems.

You may stop using the Services at any time by deleting the app from your device and discontinuing use. Termination does not affect provisions that by their nature should survive, including intellectual property, disclaimers, limitations of liability, and payment obligations accrued before termination.

Disclaimers

The Services are provided on an "as is" and "as available" basis to the fullest extent permitted by law. Paradise Technology LLC disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not guarantee that the Services will always be available, uninterrupted, error-free, secure, or compatible with every device, subscription, operating system, or third-party platform.

Limitation of Liability

To the fullest extent permitted by law, Paradise Technology LLC and its owners, affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, revenue, profits, goodwill, or business opportunities arising out of or related to your use of the Services.

To the fullest extent permitted by law, our total liability for any claim relating to the Services will not exceed the amount you paid to Paradise Technology LLC for the applicable Service during the 12 months before the event giving rise to the claim.

Changes to These Terms

We may revise these Terms from time to time. When we do, we will post the updated version at this URL and revise the "Last updated" date above. Continued use of the Services after the revised Terms become effective constitutes your acceptance of the updated Terms.
